These Terms of Use ("Terms") govern your use of kaispartyrentals.com (the "Site") and our SMS messaging program, operated by Kais Party Rentals LLC ("Kai's Party Rentals," "we," "us," or "our"). By accessing the Site, submitting a quote request, or opting in to our messaging program, you agree to these Terms.

These Terms cover the website and messaging program only. Equipment rentals are governed by a separate Rental Agreement, which you will review and sign before your reservation is confirmed. Nothing on this page creates a rental contract or reserves inventory.

Our collection and use of information is described in our Privacy Policy.

How You Opt In

You may opt in to our messaging program by:

Checking the SMS consent box when submitting a quote request or contact form on kaispartyrentals.com
Providing written consent on a rental agreement or booking form

Consent to receive marketing text messages is not a condition of purchasing any goods or services from us. You may request a quote, book a rental, and receive service without opting in to marketing text messages.

2. Kai's Party Rentals Messaging Terms and Conditions

The messaging program consists of general conversational messaging to answer questions and provide support to customers.
You can cancel the SMS service at any time. Just text 'STOP' to the phone number from which you received messages. After you send the SMS message 'STOP' to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@kaispartyrentals.com.
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3. Data Sharing

Customer data is not shared with 3rd parties for promotional or marketing purposes.
Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in these Terms or in our Privacy Policy excludes mobile opt-in data.

4. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

Interfere with or disrupt the Site, its servers, or its networks
Attempt to gain unauthorized access to any part of the Site or its underlying systems
Use automated tools to scrape, harvest, index, or copy Site content
Submit false, misleading, or fraudulent information through any form
Submit another person's contact information without their permission
Transmit malware, harmful code, or automated spam
Use the Site or its content for a competing commercial purpose

We may suspend or block access to the Site for any violation of these Terms.

5. Quote Requests Are Not Reservations

Pricing, availability, package contents, and equipment specifications shown on the Site or generated by our online quote builder are estimates only.

Submitting a quote request does not reserve equipment or hold a date.
Inventory is confirmed only when we issue written confirmation and receive the required deposit.
Quoted pricing is subject to change until confirmed in writing, and may be revised based on delivery distance, site access, event duration, or seasonal demand.
Availability is first-come, first-served based on signed agreements and deposits, not on quote requests.

6. Email Communications

By submitting your contact information, you agree that we may contact you about your inquiry by email and phone.

You may unsubscribe from marketing email using the link in any marketing message. Unsubscribing from marketing email does not stop email about an active quote or reservation.

Do not submit another person's phone number or email address to us without their consent.

7. Intellectual Property

All content on the Site — text, photography, logos, brand marks, illustrations, layout, and design — is owned by Kais Party Rentals LLC or its licensors and is protected by copyright and trademark law.

You may not reproduce, republish, distribute, or create derivative works from Site content without our written permission. You may share links to our pages and use our published photographs for personal, non-commercial reference.

Event photography. Photographs on the Site depict past installations. Setups shown may include equipment or configurations not currently available, and are illustrative rather than a guarantee of what your event will look like.

8. Accuracy of Site Content

We work to keep the Site accurate and current, but we do not warrant that all descriptions, dimensions, capacities, seating guidance, pricing, or availability are free of error. Tent sizing guidance, guest count recommendations, and layout suggestions are general planning tools, not engineering or safety determinations for your specific site.

We may correct errors, update pricing, and modify or discontinue any part of the Site at any time without notice.

9. User Submissions

If you submit a review, photograph, testimonial, or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content in our marketing. You represent that you own or have permission to share what you submit. Contact us at any time to request removal.

10. Third-Party Links and Services

The Site links to and integrates third-party services, including venues, payment providers, analytics platforms, and social media. We do not control and are not responsible for the content, availability, or privacy practices of those services.

11. Disclaimer

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or our messaging program. Our total liability arising from the Site will not exceed $100.

Liability arising from an actual equipment rental is addressed in the signed Rental Agreement, not here.

Nothing in these Terms limits liability that cannot be limited under Michigan law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute arising from the Site or our messaging program will be brought exclusively in the state or federal courts located in Macomb County, Michigan, and both parties consent to that jurisdiction.

14. Severability

If any provision is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full effect.

15. Changes to These Terms

We may update these Terms at any time. The "Last updated" date above reflects the current version. Continued use of the Site after changes are posted constitutes acceptance.
